Outpatient Competency Examination Program

People charged with crimes must be competent to understand the court process and the possible outcomes of this process. If any representative of the court process questions whether a person is competent, the court may order a competency examination. In Wisconsin, most competency examinations are conducted in outpatient settings like county jails. The Outpatient Competency Examination Program is responsible for this work. 

The Division of Care and Treatment Services contracts with the Wisconsin Forensic Unit to conduct outpatient competency examinations.

Process 

The court sets a hearing date on the competency examination to occur 15 days after the examination is ordered. Place the date on the court order (CR-205). 

Attach a copy of the criminal complaint and all relevant mental health records to the court order (CR-205).

The Clerk of Circuit Courts faxes the court order and criminal complaint to the Wisconsin Forensic Unit and shares the location of the defendant (jail or elsewhere).

The Wisconsin Forensic Unit contract examiner will generate the report and fax the report to the court, district attorney, and defense attorney.
