Disclosure Policy and Notifications

Changes in status

Entities need to know when their employees, contractors, or non-client residents are undergoing investigation or have been convicted of a crime or certain governmental offenses. These events may affect eligibility to work as a caregiver or to reside in entity facilities. The Division of Quality Assurance (DQA) must also be informed when similar events affect personnel that received regulatory approval (e.g., licensees, certificate holders, etc.) or when new approval may be required.

Notification criteria

  • Conviction for a crime
  • Investigation by a governmental agency for abuse, neglect, or misappropriation
  • A finding of abuse, neglect, or misappropriation of client property
  • Denial of a license or a license restriction imposed by the Wisconsin Department of Safety and Professional Services

Policy requirement and notification to entity

Wisconsin Admin. Code § DHS 12.07 requires entities to establish personnel and operating policies that require caregivers to notify them as soon as possible, but no later than the next working day, when the caregiver fits the criteria listed above.

Notification to DQA and background check

Entities must notify DQA at dhsofficeofcaregiverquality@dhs.wisconsin.gov as soon as possible, but no later than the next business day, when a person that received regulatory approval (e.g., licensees, certificate holders, etc.) or a non-client resident fits the criteria listed above.

New non-client residents or other license

Entities must notify DQA at dhsofficeofcaregiverquality@dhs.wisconsin.gov as soon as possible, but no later than the next business day, when a new person intends to reside in an entity facility as a non-client resident, or when approval is required for a new licensee.

Entities must also apply for a "Non-Client Resident" or "Entity Operator" background check for these persons at that time.
