Re: ICF-MR Restructuring Initiative

The Department is revising the eligibility criteria for the ICF-MR Restructuring Initiative to include certain people admitted to ICFs-MR on or after January 1, 2005.

BACKGROUND

Starting in 2005, the ICF-MR Restructuring Initiative provided two fundamental changes: (1) New admission restrictions and corresponding changes in periodic review processes, and (2) Realignment of existing funding mechanisms and responsibilities so that funding that supported persons in ICFs-MR and nursing facilities at a DD Level of Care could be used to support those persons in smaller community settings. Since the establishment of the program, eligibility for relocation under the ICF-MR Restructuring Initiative has been limited to those persons in facilities at a DD Level of Care at the end of 2004. Since the start of the initiative over 600 persons have been relocated. Of the original cohort of eligible persons, there are now fewer people in facilities eligible for relocation than have been relocated into the community. This is a tremendous accomplishment and would not have been possible without the hard work of facilities, counties and Department staff.

NEW ELIGIBLITY CRITERIA

The Department is revising the eligibility criteria for the ICF-MR Restructuring Initiative to extend the opportunity for relocation to those persons admitted after January 1, 2005 who have been admitted on a long term basis following the procedures in 2003 Wisconsin Act 33. In order to be eligible persons admitted after January 1, 2005 will have to have been admitted via a court proceeding in which the court found that the facility was the most integrated setting taking into consideration a county prepared plan for home or community based care. In addition, in a subsequent Watts review or court proceeding, a court will have to find that a plan for home or community based care now provides the most integrated setting for the individual.

In order to relocate a person from a facility using Restructuring funding, the county proposing a change in placement will have to submit the documentation for the person's placement in the facility including the court determination and plan for home or community based care. In addition the county will have to submit the new plan if the plan has changed, along with an explanation of the changed circumstances that now make the community the appropriate placement for the individual.

Counties are encouraged to include those people who relocate under the Restructuring initiative in the Money Follows the Person demonstration. This federal demonstration provides the state with enhanced federal match for expenditures on home and community-based services for persons relocated to the community.
