Who is a Qualified Person with a Disability under
ADA?
When the Americans with Disabilities Act (ADA) became law in 1990,
employers were prohibited from discriminating against qualified people with disabilities.
An individual with a disability
is a person who has a physical or mental impairment, has a record of such an impairment, or is regarded as having such
an impairment.
A qualified individual with a disability is a person who, with or
without reasonable accommodation, can perform the essential functions of the job in
question.
All applicants, whether or not they have a disability, must have the required education, licenses and skills in order to be considered qualified.
